Terms of Service

The service

Vitapia provides AI-generated audience-reaction forecasts, Pre-Flight Check risk review, and related research-support tools for marketing and communications teams.

Outputs are model-based forecasts and decision support. They are not measurements of real people, guarantees of outcomes, or a substitute for primary research, legal review, or professional judgment. See our Methodology page for more on scope and limitations.

Your account

You must provide accurate registration information and verify your email before the account is activated. You are responsible for all activity under your account and for keeping your credentials secure.

The service is intended for businesses and individuals conducting legitimate marketing and communications research. You must be legally able to enter into these Terms.

Acceptable use

You agree not to use the service for unlawful, harassing, defamatory, or discriminatory purposes; to submit content you do not have the rights to analyze; to attempt to reverse-engineer, scrape, or overload the service; or to present Vitapia's forecasts as real human survey responses without disclosing that they are AI-generated.

Credits, billing, and plans

Access is metered by credits purchased through subscription plans or top-ups, processed by Stripe. Fees are as displayed at checkout, billed in advance, and generally non-refundable except as required by law. We may change pricing with reasonable notice.

Content you submit

You retain ownership of content you submit, such as draft copy, business context, and uploaded media. You grant us a license to process that content solely to provide the service to you, and you represent that you have the rights to submit it.

Disclaimers

The service is provided “as is.” Outputs are forecasts, not observations, and are not guaranteed to be accurate or complete. Consequential decisions require human review and, where appropriate, primary research.

Limitation of liability

To the extent permitted by law, Vitapia is not liable for indirect, incidental, or consequential damages arising from use of the service, and our total liability is capped at the fees you paid in the three months preceding the claim.

Termination

You may stop using the service at any time. We may suspend or terminate accounts that breach these Terms, including the Acceptable Use section above.

Governing law

These Terms are governed by the laws of Hong Kong, and disputes are subject to the exclusive jurisdiction of the Hong Kong courts.

Changes to these Terms

We may update these Terms from time to time. Continued use of the service after an update constitutes acceptance; we will notify you of material changes by email or in-app notice.
